Southern Shells — Terms of Service

Agreement
By visiting southernshells.com or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the site.
Who may order
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.
Products, pricing, and availability
We sell fresh seafood and other products whose availability depends on the catch, the season, and the weather. Product descriptions, photographs, and availability are provided in good faith but may not always be exact — seafood varies naturally in size, color, and appearance.
We reserve the right to correct pricing or description errors, limit quantities, and refuse or cancel any order, including after an order has been placed. If we cancel an order you have paid for, we will refund you in full.
Prices are in U.S. dollars and may change without notice.
Orders and payment
Your order is an offer to purchase. We accept it when we confirm and fulfill it. Payment is processed at checkout through our payment providers.
Because seafood is cut, weighed, and packed to order, some items are priced by weight and the final charge may differ slightly from the estimate shown at checkout. Any such difference will be reflected in your final receipt.
Shipping, returns, and refunds
Our Shipping Policy and Refund and Return Policy are incorporated into these terms.
Acceptable use
You agree not to use the site to break any law, infringe anyone's rights, transmit malicious code, scrape or harvest data, interfere with the site's operation, or attempt unauthorized access to any part of it.
Intellectual property
The Southern Shells name, logo, shorebird and shrimp marks, site content, product photography, and design are our property or used under license, and may not be reproduced without written permission.
Third-party links and services
Our site uses third-party services and may link to third-party sites. We are not responsible for their content, policies, or practices.
Food safety and allergens
Seafood is a known allergen. Our products are handled in a facility that processes shellfish and finfish, and cross-contact is possible. Consuming raw or undercooked seafood increases your risk of foodborne illness. It is your responsibility to store, handle, and cook products safely after they reach you.
Disclaimer of warranties
Except as expressly stated, the site and products are provided "as is" without warranties of any kind, to the fullest extent permitted by law. Nothing here limits any warranty that cannot be limited under applicable law.
Limitation of liability
To the fullest extent permitted by law, Southern Shells is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the order giving rise to it.
Indemnification
You agree to indemnify and hold harmless Southern Shells and its owners and employees from claims arising out of your breach of these terms or misuse of the site.
Governing law
These terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts serving Mobile County, Alabama.
Changes
We may update these terms at any time. Continued use of the site after changes means you accept them.
